Required disclosures for Texas real estate license holders

Information About Brokerage Services

Texas law requires all real estate license holders to give the following information about brokerage services to prospective buyers, tenants, sellers, and landlords.

A broker is responsible for all brokerage activities, including acts performed by sales agents sponsored by the broker. A sales agent must be sponsored by a broker and works with clients on behalf of the broker.

As agent for owner (landlord): the broker represents the owner, usually through a written listing or property management agreement. As agent for buyer/tenant: the broker represents the renter, usually through a written representation agreement. As agent for both (intermediary): the broker may act as an intermediary only with the written agreement of both parties.

A license holder must treat all prospective clients honestly and fairly, inform the renter of any material information about the property known by the agent, and answer the renter's questions honestly.
